Terms of Service — LaClave Creative

Welcome to LaClave Creative (“LaClave Creative,” “we,” “us,” “our”). These Terms of Service (“Terms”) govern your use of laclavecreative.com (the “Site”) and any purchase you make from us.

By accessing the Site or placing an order, you agree to these Terms.

1) Who These Terms Apply To

In these Terms:

  • “you” means any visitor, user, or customer of the Site.

  • “Customer” means someone who places an order.

  • “Products” means items sold on our Site (including made-to-order print-on-demand items).

2) Changes to These Terms

We may update these Terms from time to time. When we do, we will update the “Last Updated” date. If changes are material, we may provide additional notice on the Site.

3) Privacy and Cookies

Our collection and use of personal information is described in our Privacy Notice and Cookie Notice. These documents are part of your agreement with us.

4) Eligibility

You must be able to form a legally binding contract to use this Site and make purchases. If you use the Site on behalf of a business, you represent you have authority to bind that business.

5) Account Information and Accuracy

You agree to provide accurate, current information for:

  • shipping address,

  • billing details,

  • email/phone (if provided),

  • any notes required to fulfill your order.

If you enter an incorrect address or contact information, delivery delays or failures may occur, and additional fees may apply.

6) Orders, Pricing, and Payment

A) Order acceptance

Your order is an offer to purchase. We may accept, reject, or cancel an order in certain situations (for example: payment issues, suspected fraud, inventory/production constraints, listing errors).

B) Pricing and errors

Prices are shown on the Site and may change at any time. If a product is listed at an incorrect price or with incorrect information due to an error, we may cancel the order and refund you.

C) Taxes

Sales tax may be collected where required.

D) Payments

Payments are processed through Squarespace-supported payment providers (for example, Stripe/PayPal, depending on your checkout method and our settings). We do not store your full payment card number.

7) Print-on-Demand (Made-to-Order) Disclosure

Many LaClave Creative products are made to order (print-on-demand). That means items are produced after you place your order.

Because of this:

  • production begins shortly after ordering,

  • cancellation/change windows can be limited,

  • minor variations may occur (see Section 9).

We may use fulfillment partners such as Printify and/or Printful (and their print providers) to produce and ship items. Order details are shared with these partners only as needed to fulfill your order.

8) Shipping, Delivery, and Delays

Shipping times typically include:

  • Processing/production time (made-to-order production), plus

  • carrier shipping time.

Estimated timeframes may appear on product pages or at checkout.

If we cannot ship within the time promised, we will provide notice and options consistent with U.S. prompt-delivery rules, including delay notices or refunds where required.

9) Product Details, Mockups, and Variations (Important)

We work hard to represent products accurately, but you acknowledge:

  • Mockups: Some product images may be digital mockups for display.

  • Color: Colors may vary by screen settings and print process.

  • Placement: Print placement may vary slightly.

  • Sizing: Apparel sizing can vary by style/brand; use the size chart when provided.

  • Handcrafted finishing: Some products and final design touches may include human review and edits.

These normal variations are not considered defects.

10) Returns, Refunds, Exchanges, and Replacements

Our Returns/Refunds Policy and Shipping Policy explain what qualifies for refunds or replacements (for example: damaged items, defects, wrong item received), what timelines apply, and what proof may be needed (such as photos).

These policies are part of your agreement with us and may be linked on the Site and/or at checkout. Squarespace Commerce supports displaying policy links at checkout.

11) Promotions and Discount Codes

Discount codes:

  • may have expiration dates,

  • may exclude some items,

  • may not be combinable unless stated,

  • are not valid on past purchases unless we state otherwise.

12) Intellectual Property (Our Designs and Site Content)

All content on the Site—including artwork, designs, text, product names, logos, photos, and graphics—is owned by LaClave Creative or licensed to us, and is protected by intellectual property laws.

You may:

  • view the Site and print/download limited materials for personal, non-commercial use.

You may not:

  • copy, reproduce, sell, distribute, or create derivative works from our designs or Site content without written permission.

13) User Content (Reviews, Comments, Submissions)

If you submit content (such as reviews, photos, or testimonials):

  • you represent you have rights to share it, and

  • you grant LaClave Creative a non-exclusive, royalty-free license to use it for business purposes (for example: product pages, marketing, and social media), unless you explicitly request otherwise in writing.

We may remove user content at our discretion.

14) Prohibited Uses

You agree not to:

  • violate any law,

  • attempt unauthorized access to the Site or systems,

  • transmit malware or harmful code,

  • scrape or harvest data from the Site,

  • impersonate others or misrepresent affiliation,

  • use our content/designs commercially without permission.

15) Marketing and Advertising Disclosures

If we make an offer, claim, or promotion, we aim to present required disclosures clearly and close to the claim (not hidden).

16) Disclaimer of Warranties

The Site and Products are provided “as is” and “as available” to the fullest extent permitted by law.

We do not guarantee the Site will be uninterrupted or error-free. We disclaim implied warranties where allowed (including merchantability and fitness for a particular purpose).

Some states do not allow certain disclaimers, so parts of this section may not apply to you.

17) Limitation of Liability

To the fullest extent permitted by law, LaClave Creative will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Site or purchase of Products.

Our total liability for any claim related to a purchase will not exceed the amount you paid for the Product(s) at issue.

Some states do not allow certain limitations, so parts of this section may not apply to you.

18) Indemnification

You agree to indemnify and hold harmless LaClave Creative from claims, damages, and expenses arising from your misuse of the Site, violation of these Terms, or infringement of any rights of another person or entity.

19) Dispute Resolution (Informal First)

Before filing a formal claim, you agree to contact us and attempt to resolve the issue informally.

20) Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict of laws principles.

Unless otherwise required by applicable law, any legal action will be brought in the state or federal courts located in Texas, and you consent to jurisdiction there.

21) Severability

If any part of these Terms is found unenforceable, the remaining sections remain in effect.

22) Entire Agreement

These Terms, along with our posted policies (including Privacy Notice, Cookie Notice, Shipping Policy, and Returns/Refunds Policy), form the entire agreement between you and LaClave Creative regarding your use of the Site and purchases.
